What is an EB1A - Extraordinary Ability (Direct Legal Permanent Residence) visa?
You must be able to demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. Your achievements must be recognized in your field through extensive documentation. No offer of employment is required. You must meet 3 of 10 criteria, or provide evidence of a one-time achievement (i.e., Pulitzer, Oscar, Olympic Medal, etc.)
Criteria Demonstrating Extraordinary Ability

Evidence of receipt of lesser nationally or internationally recognized prizes or awards for excellence

Evidence of membership in associations demanding outstanding achievement of their members.

Evidence of published material in professional or major trade publications or other major media.

Evidence that you have been asked to judge the work of others, either individually or on a panel.

Evidence that you have been asked to judge the work of others, either individually or on a panel.

Evidence of your original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field.

Evidence that your work has been displayed at artistic exhibitions or showcases.

Evidence of your performance of a leading or critical role in distinguished organizations.

Evidence that you command a high salary or other significantly high remuneration in relation to others in the field.

Evidence of your commercial successes in the performing arts.
Additional Personal Documentation Needed:
In addition to the documentation requested regarding your qualifications for being classified as an outstanding researcher/professor, please provide the following additional documents:

Copies of all degrees (if not already provided to our office)

Copies of form I-94 for you, your spouse and children (if applicable).

Copies of all passports.
Application Procedure

Once you have provided all of the information to us, we will prepare all Immigration forms and write a support letter on behalf of your employer or yourself.

Then we will file the visa petition with the US Citizenship and Immigration Service (USCIS). The processing time is varied for each USCIS service center.

Once USCIS approves the petition, we will then commence processing the application for permanent residency/immigrant visa through USCIS office in the United States or a U.S. Consulate/Embassy abroad.

The processing of this application is also dependent on whether your priority date is current for the visa bulletin. At this time, the Category 1 for Employment Based Visas is current for all countries
